Agreement to Terms

By accessing our website or engaging our services, you agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, please do not use our services.

Services Description

Fragranceocandle provides outdoor design services including:

  • Balcony and terrace design
  • Flower bed planning and styling
  • Seasonal plant arrangements
  • Container garden design
  • Urban greenery solutions

Services are tailored to each client's specific needs and site conditions. Final deliverables and scope will be outlined in individual service agreements.

Service Limitations

Our services are design-focused and consultative in nature. We do not:

  • Make claims about environmental impact or air quality improvements
  • Provide guarantees regarding plant performance or longevity
  • Offer certifications or professional credentials beyond design expertise
  • Make medical or health-related claims about plants or outdoor spaces

Client Responsibilities

Clients are responsible for:

  • Providing accurate information about their space and requirements
  • Obtaining necessary permissions for installations or modifications
  • Ensuring safe access to work areas
  • Following provided care instructions for plants and installations
  • Arranging for ongoing maintenance as recommended

Intellectual Property

All design concepts, plans, and materials created by Fragranceocandle remain our intellectual property unless otherwise agreed in writing. Clients receive a license to use designs for their personal project but may not reproduce or distribute them.

Payment Terms

Payment terms will be specified in individual service agreements. Generally:

  • Consultation fees are due at time of booking
  • Design fees are typically split between project milestones
  • Installation services require deposit before work begins
  • Final payment is due upon project completion

Cancellation and Refunds

Cancellation policies vary by service type and will be outlined in your service agreement. Generally, consultations cancelled with less than 48 hours notice are non-refundable. Design work in progress is billed for time invested.

Limitation of Liability

To the fullest extent permitted by law, Fragranceocandle shall not be liable for:

  • Plant mortality due to factors beyond our control (weather, pests, maintenance)
  • Indirect or consequential damages arising from our services
  • Issues resulting from failure to follow care instructions
  • Changes made to designs or installations after our work is complete

Our total liability shall not exceed the amount paid for services rendered.

Force Majeure

We are not liable for delays or failures in performance resulting from circumstances beyond our reasonable control, including but not limited to acts of nature, weather events, supplier issues, or other unforeseeable circumstances.

Dispute Resolution

Any disputes arising from these terms or our services shall be resolved through good faith negotiation. If resolution cannot be reached, disputes shall be subject to binding arbitration in San Diego, California, under the rules of the American Arbitration Association.

Governing Law

These Terms and Conditions are governed by the laws of the State of California and the United States, without regard to conflict of law provisions.

Changes to Terms

We reserve the right to modify these terms at any time. Changes will be posted on this page with an updated revision date. Continued use of our services after changes constitutes acceptance of the modified terms.
